1. FORMATION OF CONTRACT
1.1 Bookings cannot be accepted from persons less than 22 years of age at the time of booking. We reserve the right to refuse a booking without giving any reason.
1.2 The client who made the reservation must be present on the day of entry.
1.3 If we refuse a booking or cancel the rental contract any paid deposit will be paid back in max. 7 days.

2. PAYMENT
2.1 Failure to complete the first payment within the agreed period will make this agreement none and void.
2.2 The balance must be paid no later than eight weeks before arrival. Failure to pay on time may result in the cancellation of the rental agreement.

3. SECURITY DEPOSIT
We require the payment of a Security Deposit to cover the cost of any damage or breakages to the property or its contents. The security deposit will be paid by credit card prior to check-in. The deposit will be returned to your credit card within a maximum of 7 days subject to no damages.


4. ARRIVAL AND DEPARTURE
You should arrive between 16.00 and 22.00 on the holiday start date and the first guests arriving of your group at the property must have a valid credit card for paying the security deposit. If you can’t pay the security deposit you are not allowed to stay at the property. If one of our team has to come a second time to charge the security deposit and handover the keys this will have a cost of 30,- €.

The accommodation must be vacated by 11.00 on the last day unless you have a different agreement with us. The cleaning team must have access at 09.00 a.m. at your departure day to all bedrooms for starting with the final cleaning if necessary. From 09.00 a.m. to 11.00 a.m. you can use the kitchen, dining area, pool and terraces and one bathroom. If these times are difficult, please advise us at the time of booking. If the cleaning team has no access to the bedrooms at 09.00 a.m. or you vacate the property after 11:00 a.m., we may not be able to hand over the house to the new guests on time. If we have to compensate the new tenants financially, we will be forced to deduct this from the security deposit.

5. PRICES FOR HANDOVER KEYS AND INTRODUCTION OF THE PROPERTY:
16.00 – 22.00 without any charge, 22.00 – 00.00 we charge 15,- € extra, after 00.00 we charge 30,- € extra.

6. BEHAVIOUR
The person signing the contract is responsible for the proper and decent behaviour of the group. Please remember that you are renting a property in a neighbourhood where neighbours quiet hours must be respected. Loud music, parties, etc., are not permitted after 9:00 PM. If you and your group do not respect these rules, we may, at our sole discretion, ask you and your group to leave the property without any refund.

7. NUMBER OF PEOPLE PERMITTED IN THE HOLIDAY HOME
The number of guests staying at the property must not exceed the number of sleeping places indicated in the property description except in the case of infants less than two years or by prior agreement with us. In the event that the maximum number is exceeded without prior arrangement, we reserve the right to refuse or revoke the booking at our sole discretion.

8. SOCIAL EVENTS AND OTHER FUNCTIONS
We do not allow social events and other functions (weddings, receptions, large cocktail parties, etc.) on the property without prior agreement. Permission will be required for any event to be attended by more than the number of sleeping places indicated in the property description. If there are more people in the property than the number of sleeping places indicated in the property description, the agent has the right to cancel the rental contract and the tenants have to leave the property immediately. If the agent needs to cancel the rental contract for this reason there will be no refund of the rental fee or security deposit.

9. ELECTRIC CONSUMPTION
Normal electricity consumption as mentioned on page 1 is included. Any higher consumption (such as charging an electric car, using air conditioning with the windows open, etc.) will incur an additional cost of 0.20 €/kW. A deposit will be charged as per page 1 of the contract at the establishment via credit card for any possible excess of electricity consumption.

10. CLEANING
The property will be clean throughout at the beginning of the rental period. There is a final cleaning charge.

11. GARBAGE
Please put the garbage in the trash cans on the street. For hygiene reasons, no garbage can be stored in the house or on the property. Finding garbage in the house or on the property during the final cleaning may result in the loss of the security deposit.

12. CANCELLATION BY YOU
12.1 Any cancellation by you (for whatever reason) must be in writing addressed to us by email. The effective date of cancellation is the date on which written notification is received by us.
12.2 If you cancel eight weeks or more before arrival you will lose your deposit.
12.3 If you cancel within eight weeks of arrival or if the booking is cancelled by us due to non-payment, we shall be entitled to the full holiday cost from you.
12.4 If you need to cancel the reservation at any time we will always try to rent out your dates again. If we are able to rent out your dates we will refund you all payments.

13. INFORMATION
13.1 While we make every effort to ensure that descriptions supplied by the Property Owners are accurately reproduced, we cannot accept responsibility for errors contained therein or the results thereof. You must accept that minor differences between the photograph/illustration/text used and the actual property may arise.
13.2 Property Owners reserve the right to make modifications to the property specification that are considered necessary in the light of operating requirements. In the interests of continued improvement, Property Owners reserve the right to alter furniture, fittings, amenities, facilities or any activities, either advertised or previously available, without prior notice.

14. HOUSE KEYS
At check in you will receive sets of key/remote controls of the house. We will confirm in writing during the check in how many sets of keys you will receive. If the day of departure there are keys/remote controls missing, we will charge each key with 20,- € and every remote control with 70,- €.

15. ACCESS
Our agents shall be allowed free access to the holiday accommodation with prior notice at any time during any holiday occupancy for the purposes of inspection and maintenance.

16. PETS
16.1 If pets are not allowed and we discover, for example during the final cleaning, that pets were present in the house during your stay, we reserve the right to retain the security deposit.
16.2 If pets are allowed, an additional cleaning fee and a security deposit for any potential damages will be charged, as specified on the vacation rental website.

17. YOUR RESPONSIBILITIES
You must keep the holiday accommodation and all furniture, fittings, effects, facilities and equipment in the same state of repair and condition as at the commencement of the holiday, and leave the holiday accommodation in the same state of general order in which it was found. You are responsible for all damage or loss which occurs to the property or its contents during your occupation, and will be responsible to paying appropriate compensation to us.

18. LIABILITY OF US AND THE PROPERTY OWNER
18.1 We will not be liable for the death or personal injury of you or any person staying on the property, unless this results from proven negligence on the part of the owner, ourselves, or our employees.
18.2 We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control, including though not limited to, act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, bye-laws, or measures of any kind on the part of any governmental or local authority, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions. In any such case we shall be entitled to treat the contract as discharged.
18.3 In the event of such discharge, our liability shall be limited to the return of the sums paid to us in respect of the (unused) portion of the holiday calculated on a pro rata daily basis.
18.4 Mechanical equipment breakdowns can occur, such as pumps, boilers, pool filtration systems, etc., as well as utility outages like water, gas, and electricity failures. We will try to repair or resolve the issue as quickly as possible.
18.5 We are not responsible for noise or disturbance originating beyond the boundaries of the holiday accommodation or which is beyond our control.

19. STAFF
We have external cleaning staff and chefs available for an additional fee, although these services cannot be guaranteed. Please notify us as far in advance as possible and we will try to assist you. We are not responsible for any external staff or services you hire. Any other arrangements you make with external personnel providing services while you are staying at the property are between you and those personnel, and we are not responsible for the services provided or the terms under which they are agreed.

20. LINEN AND TOWLES
Bed linen, towels and beach towels are included. At the day of check in we will count all towels with you and at departure we will count them again.
Please keep the sheets and towels clean of traces of creams, oils, etc., especially sun creams. High protection sun creams damage towels and sheets and leave stains that cannot be removed. If we find stains of this type or missing any towels, we are obliged to charge you from the deposit for their replacement.

21. NO FOOD IN BEDROOMS
It is not allowed to eat in the beds or bedrooms. This can provoke plague of animals into the house and a special cleaning might be necessary which could be deducted from you security deposit.

22. SWIMMING POOLS (In case of property with swimming pool)
Before using the pool please shower to remove excess sun cream, with many persons using the pool in the hot summer months it will be impossible to keep the water quality high. Failure to do this may result in loss of the security deposit. The pool will be checked for water quality every week; pool cleaning is by outside contractor charged to the owner. If you are in any doubt with regard to the water quality call us immediately and we will come and inspect.

23. POOL HEATING PUMP (In case of pool with heating pump)
In case your pool has a pool heating pump and you have not ordered and paid to heat up the swimming-pool, you are not allowed to manipulate the pool heating pump on your own. If the pool heating pump is manipulated by you or your group you can lose your security deposit.

24. PHOTOGRAPHY
Photographs taken at our properties cannot be used or sold for profit without authorization from us.

25. SECURITY AND VALUABLES
Any valuables left at the property are left at your own risk. We are not responsible for their loss against theft and burglary. We accept no responsibility for any loss, damage or consequential losses due to theft or any other security related incident whatsoever caused.

27. SMOKING
Smoking is allowed outside only. If during the final cleaning we find evidence that someone has smoked inside the property, it may result in the loss of the security deposit.

28. LAW
All contractual obligations arising out of these booking conditions shall be deemed to come into existence in Spain, and be subject to Spanish law and the exclusive jurisdiction of the Spanish courts of Alicante.
